The Federal government, the State of North Carolina, utilities, and local government have the right to “take” private property for public use under certain circumstances. The Fifth Amendment of the United States Constitution provides, “Nor shall private property be taken for public use without just compensation.” However, when a government authority seeks to take someone’s land, there is often a disagreement about what is “just compensation."
